Terms of Service
1. Introduction and Acceptance
These Terms of Service ("Terms") govern your use of the OZmate mobile application and website ("the Service"), operated by RootPilot AI ("the Operator"). By creating an account or using the Service, you agree to these Terms, our Privacy Policy, and our Community Guidelines.
2. Description of the Service
OZmate supports people with working holidays, study abroad, and travel in Australia. Features include community forums, group chat, direct messaging, a marketplace bulletin board, map-based location information, and content about life in Australia.
3. Eligibility
You must be at least 18 years old to use the Service. By creating an account, you represent and warrant that you are 18 or older.
4. Account Registration
- Register with a valid email address and create a password.
- Provide accurate and current information.
- One account per person.
- You are responsible for your login credentials and all account activity.
- Report suspected unauthorized use to support@rootpilotai.com immediately.
5. User Content and License
Ownership: You retain ownership of your User Content.
License: You grant us a non-exclusive, worldwide, royalty-free, sublicensable license to use your content as necessary to operate the Service. This license ends when you delete your content or account, except where your content has been shared with others and they have not deleted it.
Removal: You may delete your content at any time. We may remove content that violates these Terms.
6. Prohibited Conduct
- Violation of laws or regulations
- Harassment, bullying, or intimidation
- Hate speech or discriminatory content
- Sexual or explicit content
- Impersonation
- Spam, unsolicited ads, or repetitive content
- Unauthorized disclosure of personal information
- Security circumvention or interference
- Service disruption
- Deliberate misinformation
- Ban evasion
- Scraping or unauthorized automated access
7. Marketplace Disclaimer
The marketplace is a bulletin board. OZmate is not a party to any transaction. All negotiations, payments, deliveries, and disputes are between the transacting parties. We provide no escrow, payment processing, delivery, or quality guarantees.
8. Intellectual Property
The OZmate name, logo, design, and UI are the Operator's property. User Content belongs to users, subject to the license in Section 5.
9. Content Moderation
We reserve the right to review, edit, restrict, or remove content at our discretion using automated tools and manual review, in accordance with our Community Guidelines.
10. Disclaimer of Warranties
The Service is provided "as is" and "as available." We disclaim all warranties including merchantability, fitness for a particular purpose, and uninterrupted or error-free operation.
Australian Consumer Law: Nothing in these Terms excludes, restricts, or modifies consumer guarantees under the Australian Consumer Law (Schedule 2, Competition and Consumer Act 2010) that cannot be excluded by agreement.
11. Limitation of Liability
We are not liable for indirect, incidental, special, consequential, or punitive damages. Total aggregate liability is limited to the greater of amounts paid in the preceding 12 months or JPY 10,000. This does not apply to damages from intentional misconduct or gross negligence under Japanese Civil Code.
12. Indemnification
You agree to indemnify and hold harmless the Operator from claims arising from your content, violations, use of the Service, or disputes with other users.
13. Termination and Suspension
By the Operator: We may suspend or terminate accounts for violations. Serious violations may result in immediate termination.
By you: Delete your account via app settings at any time.
Effect: Your right to use the Service ends immediately. Disclaimer, liability, indemnification, and governing law provisions survive.
14. Changes to These Terms
Material changes are communicated via the in-app consent flow. Continued use requires acceptance of updated Terms.
15. Governing Law
These Terms are governed by Japanese law. Where the Australian Consumer Law applies, rights that cannot be excluded under the Competition and Consumer Act 2010 (Cth) are unaffected.
16. Dispute Resolution
Disputes are subject to the exclusive jurisdiction of the court having jurisdiction over the Operator's place of business as the court of first instance.
17. Severability
If any provision is found unenforceable, the remaining provisions remain in full effect.
18. Entire Agreement
These Terms, together with the Privacy Policy and Community Guidelines, constitute the entire agreement regarding the Service.
